The Jesuit Juan de Mariana (1535-1624) is one of the most misunderstood authors in the history of political thought. His treatise "De rege et regis institutione libri tres" (1599) is dedicated to Philip III of Spain. It was to present the principles of statecraft by which the young king was to abide. Yet soon after its publication, Catholic and Calvinist politiques in France started branding Mariana a regicide. "De rege" was said to empower the private individual to kill a legitimate king. Its 'pernicious doctrines' were blamed for the murder of Henry IV in 1610, and it was burned at the order of the parliament of Paris. Modern historians have tended to build on this interpretation and consider "De rege" a stepping stone towards modern pluralist and democratic thought. Nothing could be further from the truth. The notion of Mariana as an uncompromising theorist of resistance is in fact based on the distorted reading of a few select sentences from the first book of the treatise. This study offers a radical departure from the old view of Mariana as an early modern constitutionalist thinker and advocate of regicide. Thorough analysis of the text as a whole reveals him to be a shrewd and creative operator of political language as well as a champion of the church and bishops of Castile. The argument as a whole is informed by a Catholic-Augustinian view of human nature. Mariana's bleak, at times downright cynical view of man imparts focus and coherence to a text that challenges well established terminological boundaries and political discourses. In the first instance, his deeply pessimistic appraisal of human virtue justifies his disregard of positive law. He is thus able to mould diverse elements extracted from Roman and canon law, scholastic theology and humanist literature into a deliberately equivocal discourse of reason of state. Finally, this secular interpretation of the world of politics is cleverly yoked to a thoroughly clerical agenda of reform. In fact, reason of state is made to propagate an episcopal monarchy. "De rege" is exceptional in that it strings together a curious scholastic theory of the origins of society, a conservative ideology of absolute monarchy and a breathtakingly radical vision of theocratic renewal of Spanish government and society. "Juan de Mariana and Early Modern Political Thought" elucidates the differentiated nature of political debate in Habsburg Spain. It confirms the complexity of Spanish political life in the later sixteenth- and early seventeenth century. Complementing recent work on Catholic political thought, the European reception of Machiavelli, and Spanish Habsburg government, this study offers a more complete and holistic picture of early modern Spanish political culture.

Emlyn Eisenach uses a wide range of sources, including the richly detailed and previously unexplored records of nearly two hundred marriage-related disputes from the bishop’s court of Verona, to illuminate family and social relations in early modern northern Italy. Arguing against the common emphasis on the growth of law and government in this period, her study emphasizes the fluidity of the principles that governed marriage and its dissolution, and deepens our understanding of the patriarchal family and its complex relationship with gender and status during the sixteenth century. Peopled by characters from across the social spectrum of the city of Verona and its __contado,__ Eisenach’s study moves between stories about specific individuals—serving girls seeking honorable marriage through the unlikely route of concubinage, peasant men in search of independence from their fathers, and aristocratic wives seeking revenge against adulterous husbands—and broader analyses of social, economic, and geographical patterns of behavior. She shows how the Veronese at all social levels attempted to better their familial and personal fortunes by creatively molding wedding rituals to fit their particular circumstances, or engaging in the significant but until now little understood practices of concubinage, clandestine marriage, or informal marriage dissolution. Eisenach also evaluates the first half-century of religious reforms in Verona as the leading pre-Tridentine bishop Gian Matteo Giberti and his successors challenged common practices and understandings in sermons, treatises, confessionals, and court. Emphasizing the limitations of what the religious authorities could impose on the people, she explores how learned and popular notions of marriage, family, and gender shaped each other as they were put into action in the strategies of individual Veronese.

The first real exposé of how universities have trademarked, copyrighted, branded, and patented everything they do. Universities generate an enormous amount of intellectual property, including copyrights, trademarks, patents, Internet domain names, and even trade secrets. Until recently, universities often ceded ownership of this property to the faculty member or student who created or discovered it in the course of their research. Increasingly, though, universities have become protective of this property, claiming it for their own use and licensing it as a revenue source instead of allowing it to remain in the public sphere. Many universities now behave like private corporations, suing to protect trademarked sports logos, patents, and name brands. Yet how can private rights accumulation and enforcement further the public interest in higher education? What is to be gained and lost as institutions become more guarded and contentious in their orientation toward intellectual property? In this pioneering book, law professor Jacob H. Rooksby uses a mixture of qualitative, quantitative, and legal research methods to grapple with those central questions, exposing and critiquing the industry's unquestioned and growing embrace of intellectual property from the perspective of research in law, higher education, and the social sciences. The purpose of the present book is to provide an introduction to this grammatical tradition not merely by summarizing it, but by putting it into a perspective that will make it accessible to any linguist trained in the western tradition. The reader should not by put off by the word ‘medieval': Arabic grammatical theory shares a number of fundamental similarities with modern linguistic theory. Indeed, one might argue that one reason Arabic theory has gone unappreciated for so long is that nothing like it existed in the West at the time of its ‘discovery'by Europeans in the 19th century, when the European orientalist tradition was formed, and that it it only with the development of a Saussurean and Bloomfieldian structural tradition that a better perspective has become possible.

Grade 9 Up–Boyne has written a sort of historical allegory–a spare, but vividly descriptive tale that clearly elucidates the atmosphere in Nazi Germany during the early 1940s that enabled the persecution of Eastern European Jews. Through the eyes of Bruno, a naive nine-year-old raised in a privileged household by strict parents whose expectations included good manners and unquestioning respect for parental authority, the author describes a visit from the Fury and the familys sudden move from Berlin to a place called Out-With in Poland. There, not 50 feet away, a high wire fence surrounds a huge dirt area of low huts and large square buildings. From his bedroom window, Bruno can see hundreds (maybe thousands) of people wearing striped pajamas and caps, and something made him feel very cold and unsafe. Uncertain of what his father actually does for a living, the boy is eager to discover the secret of the people on the other side. He follows the fence into the distance, where he meets Shmuel, a skinny, sad-looking Jewish resident who, amazingly, has his same birth date. Bruno shares his thoughts and feelings with Shmuel, some of his food, and his final day at Out-With, knowing instinctively that his father must never learn about this friendship. While only hinting at violence, blind hatred, and deplorable conditions, Boyne has included pointed examples of bullying and fearfulness. The first real exposé of how universities have trademarked, copyrighted, branded, and patented everything they do. Universities generate an enormous amount of intellectual property, including copyrights, trademarks, patents, Internet domain names, and even trade secrets. Until recently, universities often ceded ownership of this property to the faculty member or student who created or discovered it in the course of their research. Increasingly, though, universities have become protective of this property, claiming it for their own use and licensing it as a revenue source instead of allowing it to remain in the public sphere. Many universities now behave like private corporations, suing to protect trademarked sports logos, patents, and name brands. Yet how can private rights accumulation and enforcement further the public interest in higher education? What is to be gained and lost as institutions become more guarded and contentious in their orientation toward intellectual property? In this pioneering book, law professor Jacob H. Rooksby uses a mixture of qualitative, quantitative, and legal research methods to grapple with those central questions, exposing and critiquing the industry's unquestioned and growing embrace of intellectual property from the perspective of research in law, higher education, and the social sciences. While knowledge creation and dissemination have a long history in higher education, using intellectual property as a vehicle for rights staking and enforcement is a relatively new and, as Rooksby argues, dangerous phenomenon for the sector. The Branding of the American Mind points to higher education's love affair with intellectual property itself, in all its dimensions, including newer forms that are less tied to scholarly output. The result is an unwelcome assault on the public's interest in higher education. Brantlinger situates explorers' narratives and travelogues by such famous author-adventurers as David Livingstone and Sir Richard Burton in relation to other forms of Victorian and Edwardian prose. Through readings of works by Arthur Conan Doyle, Joseph Conrad, H. Rider Haggard, Rudyard Kipling, John Hobson, and many others, he considers representations of Africa, India, and other non-British parts of the world in both fiction and nonfiction.</p> <p>The most comprehensive study yet of literature and imperialism in the early and mid-Victorian years, <em>Rule of Darkness</em> offers, in addition, a revisionary interpretation of imperialism as a significant factor in later British cultural history, from the 1880s to World War I.
