Der AOA normiert für die Gewinnabgrenzung zwischen Stammhaus und Betriebsstätte (BS) eine uneingeschränkte Selbständigkeitsfiktion der BS durch sog. „anzunehmende schuldrechtliche Beziehungen“ bei unternehmensinternen Liefer- und Leistungsbeziehungen. Dies führt zu einer fundamentalen und äußerst praxisrelevanten Änderung der internationalen Betriebsstättengewinnabgrenzung, die der Gesetzgeber u.a. durch die BetriebsstättengewinnaufteilungsVO (BsGaV) näher konkretisiert hat. In einem ländervergleichenden Teil werden zudem die Ergebnisse einer globalen Befragung nationaler Experten zur Umsetzung des AOA wiedergegeben. Da heutzutage ab dem Mittelstand nahezu alle Unternehmen Auslandsaktivitäten nachgehen, wächst der Markt international tätiger Berater kontinuierlich, die sich alle intensiv mit dem AOA auseinandersetzen müssen. Aufgrund der stetigen Ausdehnung des BS-Begriffs durch die OECD laufen zudem immer mehr Unternehmen Gefahr, neben geplanten BS auch ungewollt BS im Ausland zu begründen. Für die sachlich richtige Gewinnabgrenzung zwischen Stammhaus und BS ist es nach der innerstaatlichen Umsetzung des AOA erforderlich, mittels eines komplexen Geflechts aus gesetzlichen Fiktionen sowie steuerlichen Hilfs- und Nebenrechnungen eine in sich stimmige Zuordnung des Aufwands und des Ertrags zu gewährleisten, da die BS „eigentlich“ rechtlich unselbständig ist und keine Verträge mit dem Stammhaus abschließen kann. Dies wird aktuell immer relevanter, da jeder Staat zunehmend darauf achtet, dass er den ihm zustehenden Anteil am Besteuerungssubstrat erhält (sog. BEPS-Diskussion). Die Autoren sind ausgewiesene Experten aus Beratungspraxis, Unternehmen, Finanzverwaltung sowie Wissenschaft und verfügen bzgl. der Gewinnabgrenzung über umfassendes Know-how in allen Fragen des Internationalen Steuerrechts.

Mit Beiträgen von Hugo W. Doppler und Jörg Schibler. Zwischen den beiden Grabungen "Im Liner" (Gemeinde Kaiseraugst / AG), über die im folgenden zu berichten ist, liegen fast vier Jahre Abstand. Die erste, die Freilegung der Wasserleitung, im Juli 1964 stand sozusagen mehr am Beginn meiner vierjährigen Tätigkeit in Äugst, die zweite, die Untersuchung des Kellers mit seinem reichen Fundmaterial, im Februar 1968, fast am Ende meiner Arbeit. Zwischen beiden Grabungen konnte ich das grosse Rasthaus im Kurzenbettli untersuchen. Die dabei gewonnenen Erfahrungen kamen der Notgrabung im Kellergebäude zugute; so war es ein Glück, dass die Freilegung der Wasserleitung relativ einfach war und mit eigentlich - in der Rückschau sagt sich das leichter - geringer Grabungserfahrung zu bewältigen war.

An Invisible Sign of My Own tells the story of Mona Gray, a math wiz and a high school track star, whose ordinary childhood comes to pieces when her father is stricken with a mysterious illness. There doesn't seem to be a name for it, but he looks sort of gray and seems frail and unhappy. Whether there's anything really wrong with Mona's dad is unclear, but her fear that he will die, as well as his withdrawal from family life--no more vacations, no running practice with his daughter, no unplanned outings--triggers a corresponding withdrawal in her. Whenever she does well at anything, or starts to enjoy herself, she quits: piano class, dancing lessons, her first boyfriend, running. I quit dessert to see if I could do it; of course I could; I quit breathing one evening until my lungs overruled; I quit touching my skin, sleeping with both hands under the pillow. When no one was home, I tied ropes around the piano, so that it would take me thirty minutes with scissors to get back to that minuet. Then I hid all the scissors. Instead of working out her problems, Mona develops a habit of knocking on wood, and sometimes knocks for an hour before getting to sleep. Eating soap is her other dark indulgence: a surefire anti-aphrodisiac that she calls on whenever she feels sexually attracted to a man. At 20, Mona is recruited to teach math at the local elementary school. To her surprise, she is a brilliant teacher, making addition and subtraction tangible to second graders with a game called Numbers and Materials, in which the students bring in natural or man-made objects that take the form of numbers. When 7-year-old Lisa Venus brings in a zero made of IV tubing from her dying mother's hospital room, Mona recognizes a kindred spirit. But she will have to be healthy herself to help Lisa resist her urge to take on her mother's illness out of grief and loyalty. The complicated connection between children and adults is the underlying theme of this big-hearted novel. Then awkward, unsociable science teacher Michael Smith, who shares Mona's morbid imagination, breaks through her emotional reserve. Meanwhile, she has developed a particular fondness for seven-year-old Lisa Venus, who is actually experiencing the real terror of loss and abandonment that Mona fears: her mother is dying of cancer. In a satisfying denouement in which Bender brings the narrative full circle with astonishing dexterity, Mona discovers how to connect and live fully, and helps Lisa to navigate her own way through a frightening world. Readers may find the narrative too schematic and the characters exceptionally odd. On the other hand, Bender writes like an angel, with images that strike resonant chords, and her sly humor pervades every page. An Invisible Sign of My Own tells the story of Mona Gray, a math wiz and a high school track star, whose ordinary childhood comes to pieces when her father is stricken with a mysterious illness. There doesn't seem to be a name for it, but he looks sort of gray and seems frail and unhappy. Whether there's anything really wrong with Mona's dad is unclear, but her fear that he will die, as well as his withdrawal from family life--no more vacations, no running practice with his daughter, no unplanned outings--triggers a corresponding withdrawal in her. Whenever she does well at anything, or starts to enjoy herself, she quits: piano class, dancing lessons, her first boyfriend, running. I quit dessert to see if I could do it; of course I could; I quit breathing one evening until my lungs overruled; I quit touching my skin, sleeping with both hands under the pillow. When no one was home, I tied ropes around the piano, so that it would take me thirty minutes with scissors to get back to that minuet. Then I hid all the scissors. Instead of working out her problems, Mona develops a habit of knocking on wood, and sometimes knocks for an hour before getting to sleep. Eating soap is her other dark indulgence: a surefire anti-aphrodisiac that she calls on whenever she feels sexually attracted to a man. At 20, Mona is recruited to teach math at the local elementary school. To her surprise, she is a brilliant teacher, making addition and subtraction tangible to second graders with a game called Numbers and Materials, in which the students bring in natural or man-made objects that take the form of numbers. When 7-year-old Lisa Venus brings in a zero made of IV tubing from her dying mother's hospital room, Mona recognizes a kindred spirit. But she will have to be healthy herself to help Lisa resist her urge to take on her mother's illness out of grief and loyalty. The complicated connection between children and adults is the underlying theme of this big-hearted novel. Auguste Rodin was a French sculptor, usually considered the progenitor of modern sculpture. But actually Rodin did not set out to revolutionary against the past. He was educated traditionally, took a craftsman-like advance to his work, and desired academic respect, although he was never accepted into Paris's leading school of art. Many of his most notable sculptures were severely criticized during his lifetime. They clashed with the predominant figure sculpture tradition, in which works were decorative, formulaic, or highly thematic. Rodin's most original work departed from traditional themes of mythology and allegory, modeled the human body with realism, and celebrated individual character. It was the freedom and creativity with which Rodin used these practices – along with his activation surfaces of sculptures through traces of his own touch and with his more open attitude toward bodily pose, sensuality, and non-realistic surface – that marked Rodin's re-making of traditional 19th century sculptural techniques into the prototype for modern sculpture. Sketcher, painter, engraver, sculptor and collector, Auguste Rodin is recognized worldwide for the exceptional authenticity of his anatomical sculptures, but drawing was his means of discovering "truth" in life and in art: for him "good" drawing represented truth and simplicity in nature; 'bad" drawing was self-conscious, mannered in its representation, and often displayed an ignorance of nature or inexact observation with attempts to mask it with artifice. Rodin was a prolific draughtsman, producing some 10,000 drawings. His drawings were seldom used as studies or projects for a sculpture or monument. Although the works on paper can only be shown periodically, owing to their fragility, the role they played in Rodin’s art was by no means minor. As the sculptor said at the end of his life: **__“It’s very simple. My drawings are the key to my work.”__**
