Many fisheries management systems have individual rights at their basis but are not always successful. The question is what would have to change in fisheries law when community rights form the basis of management. Applying this idea globally, the principle of the common heritage of humankind could provide a future foundation. The principle incorporates intra- and intergenerational justice and has a clear biocentric component but is now only applicable to the ocean floor beyond national jurisdiction and to celestial bodies other than Earth. If this principle would also apply to highly migratory fish species like Atlantic bluefin tuna, not only an analysis of the applicable law but also of the principle ́s roots in environmental ethics, the economic consequences of such application and a comparison with the idea of public trusteeship provide helpful insights. It appears that the common heritage of humankind can enable both utilisation and preservation of natural resources.

The thesis finds a normative approach to the question whether trial in absentia is suitable for International Criminal Tribunals by applying classical sources of international criminal law and combining institutional aspects of the procedural theory, specifically the goals of the international criminal trial, with the individual frameworks of fundamental rights, namely the right to be present. Through a critical analysis of concepts presented as models for trial in absentia it introduces a new concept for trials ›in absentia‹ which considers both the defendant’s right and duty to be present. In today's asymmetric armed conflicts, military agents carry out targeted killings against civilians that »take a direct part in the hostilities«. This book defines such participation for the purposes of international humanitarian, criminal and human rights law. Additionally, the general framework of the law of war is revisited, in particular under the currently frequent scenario of non-international armed conflicts. Treaty requirements for the recognition of non-state actors (degree of collectivity) are addressed and the legal ethics of a strict status-based approach in international law (combatants/civilians) is opined on. The study at hand analyzes the repertory of applicable legal texts and their authentic versions in the different official languages. It discloses existing incoherencies and gives an overview of their implementation into the national legislation of several countries. The research closes with a fictional case study. <p>Die Auswirkungen der Globalisierung werden vielfach als Bedrohung für die nationalen (Arbeits)Märkte angesehen. Die 69. Wissenschaftliche Konferenz widmete sich deshalb dem aktuellen Thema "Auswirkungen der Globalisierung auf nationale Arbeitsmärkte: Diagnose und Therapie". Vor dem Hintergrund hoher Arbeitslosenzahlen wurde mit dieser Konferenz ein Beitrag zur wirtschaftspolitischen Beratung der Bundesregierung geleistet. In den Vorträgen und Diskussionen wurden die Implikationen globalisierter Arbeitsmärkte beispielsweise für die Geld- und Fiskalpolitik, die Bedeutung der (De-)Regulierung in einem globalisierten Arbeitsmarkt und die Arbeitsmarkteffekte durch Outsourcing behandelt. Andere Vorträge widmeten sich dem Thema Einkommensausgleich und Wirtschaftseffizienz, der Förderung des Niedriglohnsektors und der Humankapitalbildung als Bestandteil der Wirtschaftspolitik.Die Vorträge und Diskussionsbeiträge stützten die These, dass die Globalisierung nicht die Hauptursache für die Probleme am deutschen Arbeitsmarkt - insbesondere für die Langzeitarbeitslosigkeit und gering Qualifizierte - darstellt, die Auswirkungen anderer Ursachen aber verstärken. Als Lösungsvorschläge wurden genannt: Flexibilisierungen am Arbeitsmarkt, Ausgestaltung der Sozialleistungen im Zusammenhang mit Arbeitslosigkeit als Hilfen zur Arbeitsaufnahme, Qualifizierung von Arbeitnehmern sowie auch gesteuerte Zuwanderung statt Abschottung der Märkte.<br></p>

On the occasion of the 50th anniversary of the end of the Eichmann trial, the Law Faculty of the University of Lisbon organized and hosted an international colloquium on the book »Eichmann in Jerusalem« that took place on April 27–28, 2011, in Lisbon. The main purpose was to evoke Hannah Arendt's oeuvre and to reflect upon the Eichmann trial. »Eichmann in Jerusalem: A Report on the Banality of Evil« is indeed an important keystone to understanding Arendt's work as a whole and constitutes a reference point in itself when addressing crucial problems in the fields of criminal law, international criminal law and philosophy of law. The main contributions, recollected for publication in the present English edition, give a rare opportunity for a kaleidoscopic and pluralistic series of views, made possible since her book gives an excellent lesson to experts in law and maintains an astonishing actuality. Cosmopolitanism relates to the ethical ideal of belonging, as a citizen of the world, to a universal community, beyond any links to particular communities. Cosmopolitics corresponds to a dual concern with affording local politics a cosmopolitan dimension and ensuring that global politics has a democratic dimension. German literature claims that modern insurance (law) has three roots: marine insurance, the co-operative protection provided by medieval and early modern guilds, and state-run insurance schemes. By contrast, English scholars suggest that there is only one root for modern insurance (law): marine insurance (law). The literature on the developments in other European countries follows similar narratives. It seems that in these countries, guilds have had no influence on the formation of insurance. The aim of the present volume is to test these different narratives. More specifically, the objective is to assess from a comparative perspective (i) whether it is possible to analyse in terms of insurance the support offered by medieval and early modern professional guilds to members in need and (ii) whether guild support had a lasting impact on the development of modern insurance and insurance law. Enterprises selecting where to locate do not have to orient themselves towards markets or inputs: as "footloose industries"", they can simply move to where they find the lowest wages. For high-wage countries like Germany it is, thus, all the more important to offer enterprises attractive locational conditions.Internationally renowned economists from the research institutes CEPII (Paris), IW (Cologne), Ifo (Munich), IfW (Kiel) and HWWA (Hamburg) present results of recent, mainly empirical studies. The aim of the present volume is to reassess the history of fire insurance and fire insurance law in selected European countries from comparative perspectives. Its point of departure is the observation that today’s state of research is unsatisfactory. Foremost, the history of fire insurance and fire insurance law presents itself differently in the various European historiographies. German authors usually assert that modern fire insurance is rooted in medieval and early modern guild support, and German literature further claims that state-run fire insurance schemes as first established towards the end of the seventeenth century were of particular importance for the development of modern fire insurance. By contrast, English literature often treats fire insurance and fire insurance law as being the offspring of marine insurance. Research in many other European countries follows English literature in treating fire insurance as being firmly rooted in marine insurance. The present volume revisits these different narratives. The doctrine of intertemporality prohibits the retroactive application of norms of international law in contentious proceedings and obliges the deciding court to positively ascertain the applicable historic rules. In situations in which the historic interaction between a European and a non-European entity needs to be litigated, problems arise. International law is lacking a universally recognised methodology, particularly regarding its unwritten rules. Also, the historic non-European peoples were often relied on oral tradition and did not produce any documentary evidence of their historic legal orders. Historically, different regions of the world produced independent legal regimes. »Meta law« governing the interactions between entities of different regimes was non-existent since no regional order did claim global rule. Hence there were no rules governing the interactions between European and non-European entities. The applicable historic law is presently ascertained by recourse to specific European phenomena. In contentious proceedings, this methodology leads to a situation of »différend« – a situation in which the method of solving the dispute already vindicates the position of one of the parties to the dispute. The thesis researches the influence of marine insurance law on the development of fire and life insurance law in the Dutch Republic (1581–1795). Fire and life insurance are often seen as offspring of marine insurance, following the latter’s principles and rules ›mutatis mutandis‹. However, this theory of marine insurance as a single starting point for other types of insurance is rebutted by the various mutual fire insurance contracts found in the Zaanstreek and other parts of the Dutch Republic. This study reviews sources already known and hitherto unknown sources. As most of the sources consist of contracts, the research deals with insurance contract law. These contracts were concluded throughout the Dutch Republic at different times by varying parties. Therefore, instead of resorting to a uniform and doctrinal approach, the study takes on a casuistic approach. While the Socialist International, bolstered by the progress of the Bolshevik revolution, claimed to offer an alternative to the weakness of Western democracies, these experienced a readjustment in the issues linked to cosmopolitanism, fuelled by the leading intellectual theories. Practically all the schools of thought and all the major intellectual figures played a part in this. Important turning points in theory were achieved. The meeting focused on the effectiveness of, and new approaches in, development cooperation. Both issues have become increasingly important in recent years in view of the declining volume of budget funds allocated to development cooperation. The papers discussing the effectiveness of foreign aid shed new light on the issue at a crucial moment where economists have begun to question the recent consensus that the productivity of aid mainly depends on the recipient country's policy environment. The last part of this volume is dedicated to an assessment of low-income countries' pension schemes based on the human capital approach.This volume represents some of the Proceedings of the Annual Meeting of the Research Committee on Development Economics (Ausschuss für Entwicklungsländer) of the German Economic Association (Verein für Socialpolitik) held in Cologne, Germany, in July 2004. The meeting focused on the effectiveness of, and new approaches in, development cooperation. Both issues have become increasingly important in recent years in view of the declining volume of budget funds allocated to development cooperation. The papers discussing the effectiveness of foreign aid shed new light on the issue at a crucial moment where economists have begun to question the recent consensus that the productivity of aid mainly depends on the recipient country's policy environment. As far as the contributions dealing with new approaches in development cooperation are concerned, these are centred on a closer integration of the private sector, by joint action with so-called lead firms in production networks on the one hand, and the mobilization of additional financial resources from international capital markets for bilateral development cooperation, on the other. The authors also make suggestions concerning critical aspects relevant for implementation. The analysis of cyclical macroeconomic phenomena is an important field of econometric research. In the recent past, research interests have de-emphasized quantitative forecasting exercises and have addressed the qualitative diagnosis of the relative stance of the economy regarding »upswing«, »recession«, or »boom« periods, i. e. the classification of the state of the economy into a limited number of discrete states. In this context the principal challenge is to reduce the multifaceted and sometimes abundant quantitative information about the business cycle to such qualitative statements in an efficient way. For more than six years this task was the focus of the project »Multivariate determination and analysis of business cycles« within the SFB 475 »Reduction of complexity in multivariate data structures«, funded by the German Research Foundation (DFG). The necessity for complexity reduction is, of course, not unique to business cycle analysis but is studied in many fields and in a number of ways. This broad interest in the reduction of problem dimensionality and in the appropriate combination of data and of theory caused the RWI Essen and the Statistical Department of the University of Dortmund in January 2002 to hold a workshop at the RWI Essen where the findings of this and similar projects were presented and discussed. The present publication collects revised versions of the papers presented at this workshop. Although the workshop took place some five years ago, these papers mark an importent juncture in the development of business cycle research.

This conference volume deals with one of the most severe economic, social and political problems major European economies face since the early nineties, the problem of lasting high unemployment. Contrary to the current German discussion, solely concentrating on microeconomic explanations and therapy recommendations, this volume presents papers based on various macro-economic points of view, showing different ways out of the employment crisis. Apart from renowned German economists, some well-known international academics participated in the 1998 Berlin symposium, to learn from experience in other countries. -- The first chapter contains the main standard textbook models and paradigms explaining lasting high unemployment. The question in the second chapter is if it is possible to fight unemployment with the help of macro policy on a purely national basis in the presence of global markets. The third chapter indicates possible effects of misalignments in financial markets on economic growth and employment. The contributions of the fourth chapter present experiences of other countries, which have succeeded in recent years in lowering their unemployment rates. The question at issue is, if these concepts can be transferred to Germany. The topics of the concluding chapter are practical macroeconomic starting points for sustainable employment growth in Europe. The methods contradict supply side arguments for the stabilisation of employment predominant in the German discussion. Attention is focused on relations between the role of monetary and fiscal policy in close conjunction with wage policy. Furthermore it is made evident that in global markets a theoretical macroeconomic concept as a base for sustainable employment is not very promising without enhanced international co-operation

German literature on the history of insurance stresses the importance of professional guilds for the shaping of insurance and insurance law. Similarly, scholars researching the genesis of Germany’s social security claim the importance of guilds as predecessor of social security. However, there is a problem with both narratives: the impact of guilds is commonly asserted but has never been analytically established. Against this background, the present contribution offers an analysis of the support offered by professional guilds from the Middle Ages to the nineteenth century. Its overall conclusion is that modern literature is correct in holding that Germany’s social security is rooted in guild welfare. However, medieval guild support had to go through two phases of transformation in the early modern period and in the nineteenth century before it was apt as a model for Bismarck’s social security legislation. The field subject who becomes a theme in it is Musa, a Hausa peasant from Niger. This study thus provides an account of his present life and tries to explain it by drawing on the literature on peasants and on Islam in the region. This book also tries to show that the study of individuals »as such« is a topic for anthropology which deserves more attention. It argues that anthropology could benefit from an explicit discussion of the notion of the individual by providing more differentiated accounts of individuals as it tries to contribute to a development of an appropriate notion of the individual for anthropology. Furthermore, it makes the point that the study of individuals contributes to a better understanding of the interrelationship between different social fields, e.g. religion and economy. This supplement presents the contributions to the 71st Annual Meeting of the Association of German Economic Research Institutes that deal with the contentious issues of "Globalization and Competition." Increased competitive intensity does not serve as a great "equalizer"; in contrast, the book identifies various areas where organizational and institutional differences sustain - a fact, important for the success of business strategies and governmental policies. In "Innovators and the Diversity of Innovation Systems" Uwe Canter and Andreas Meder analyze the determinants of cooperative invention. Regional proximity is a main driver of cooperative innovations so that path dependencies remain important even under globalization. Pio Baake und Christian Wey show that increasing demand-side market integration leads to new anticompetitive effects of mergers. In "Latin versus European Power: A Comparison of Market Reforms in Europe and Chile and Brazil" Tim Mennel and Maria Viecens show that national approaches towards utility regulations reveal persistent differences. Michael Rothgang analyzes the diversity of innovation processes while Christian Rammer and Anja Schmiele highlight the importance of absorptive capacities when innovation processes become more international. Teaching and study of law is based on the premises of formal dogma. Discussion centres on what the law says, and less on the Instruments enabling its application, such as legal argumentation and reasoning. The approach to the new legal and institutional challenges facing the European Union is not immune to this problem. Little public attention is paid to actual law emanating from EU institutions, and even less to its application. However, at least three issues of vital importance can easily be seen to originate in this field: (1) Does legal harmonisation among EU countries also mean harmonisation of criteria and forms of justification of judicial reasoning? (2) What is the relationship between each country's internal laws and European law at the application stage? And (3) what is the relationship between the application of law by European-level legal bodies and national bodies, which may, for example, assume differing levels of protection of individual rights? These and other questions concerning application of the law in the European Union were the objective of a European congress, The Judiciary and its Role in the European Construction Process, held in Girona, Spain, from 14 to 16 November 2002. The congress was funded by the European Commission via the Human Potential Programme within the European Community's 5th Framework Programme. It was part of the PhD Euroconferences in Legal Philosophy: Current Challenges to the European Legal Thought project. This book brings together the results of that congress, yet cannot be termed Proceedings, since the papers presented at the congress were later modified by the authors in light of the discussion.

This book addresses the question whether English insurance law is in its entirety rooted in marine insurance. English literature and case law indeed assert that life and fire insurance are nothing more than offspring of marine insurance. To describe life and fire insurance law as offspring of marine insurance suggests that the legal rules and principles as developed in the context of marine insurance were simply transferred as a whole to life and fire insurance. However, it is possible that the legal development happened differently. There could rather have been a convergence of the different legal regimes. To speak of a gradual convergence suggests that marine insurance law was transposed into life and fire insurance law only where appropriate. By analyzing this research question, the book unfolds the roots of modern insurance business in England as well as the evolution of English insurance law. Erscheinungsdatum: 14.11.2019

Investment treaties protect the investments of foreign investors against interference by the host state: The core standards offer protection against discriminatory or unequitable treatment and expropriation. However, the investment activities can impact on the environment of the host state. The state retains its policy space to regulate for an environmental purpose. Some investment treaties refer to concepts of international environmental law, but do not impose a hierarchy of norms. In practice, it often falls to investment tribunals to distinguish between legitimate regulation and the violation of investors' rights. They decide on the scope of the state's policy space by balancing the opposing interests: Investment tribunals focus on the absence of protectionist intent, procedural propriety and the review of scientific evidence. The German Yearbook of International Law, founded as the Jahrbuch für Internationales Recht, provides an annual report on new developments in international law and is edited by the Walther Schücking Institute for International Law at the University of Kiel. Since its inception in 1948, the Yearbook has endeavored to make a significant academic contribution to the ongoing development of international law. Over many decades the Yearbook has moved beyond its origins as a forum for German scholars to publish their research and has become a highly-regarded international forum for innovative scholarship in international law. In 1976, the Yearbook adopted its current title and began to publish contributions written in English in order to reach the largest possible international audience. This editorial decision has enabled the Yearbook to successfully overcome traditional language barriers and inform an international readership about current research in German academic institutions and, at the same time, to present international viewpoints to its German audience. Fully aware of the paramount importance of international practice, the Yearbook publishes contributions from active practitioners of international law on a regular basis. The German Yearbook of International Law was founded in 1948 as the "Jahrbuch für Internationales Recht" by Rudolf Laun and Hermann von Mangoldt and is now edited by the Institute for International Law at the University of Kiel. Since its inception it has endeavoured to contribute to the development of international law. Originally it has done this mainly by providing German scholars with an opportunity to publish the results of their works, but increasingly also by offering an international forum. In view of the desirability of obtaining for the Yearbook the largest possible international audience, the editors in 1976 have decided to use the present English title and to accept for publication preferably contributions written in English, or - to a lesser degree - in French. Naturally, the Yearbook also contains contributions written in German. This policy to overcome traditional language barriers appears to have proven successful both in informing the international law community about research done in German academic institutions and in presenting international viewpoints on various topics to the German audience. The Yearbook provides an annual report on the work of internatioal organizations and bodies including the International Court of Justice and the European Court and Commission of Human Rights. Fully aware of the paramount importance of practical aspects in this field, the editors from the beginning also have sought to include contributions from practitioners of international law
